Mediation

Mediation is a process that helps people in dispute resolve their differences, to find the best solution that everyone thinks is fair.

We have been involved in mediations in disputes or differences raising many issues, including the following:

• Business disputes over money, goods, buildings or performance.
• Disputes between business partners.
• Contested probate or estate matters.
• Family Law Property Settlement.
• Disputes involving children.

Mediation gives parties in dispute control over the way the dispute is resolved and is an alternative to litigation. The scope for resolution is much more flexible than any outcome available from courts or tribunals.

Mediation is usually conducted over a series of meetings with one or two mediators. Initially you will be contacted and asked to sign a mediation agreement. Then the mediator will contact you and conduct what is known as an “intake meeting”, where you can discuss the issues and any concerns you may have. A typical mediation lasts for between 3 and 4 hours, however this all depends on the complexity of your circumstances, and some mediations take place in up to 3-6 meetings.

The high success rate of mediation in resolving dispute is well recognised. About 80% of mediations produce a successful outcome. That is, a final resolution has been achieved by the end of the process, usually over a day or perhaps two, and usually reflected in a written agreement.

Decisions made in mediation are documented but are not legally binding. A legal agreement can be drawn up from the document by the parties own lawyers.
